A Guide to Expert Witness Evidence

A Guide to Expert Witness Evidence was written by Mark Tottenham, Emma Jane Prendergast, Ciaran Joyce and Hugh Madden, and was published in September 2019 by Bloomsbury Professional.

The book is a comprehensive guide to the issues concerning expert evidence, including: the duties of an expert witness; the admissibility of expert evidence (under a number of headings); the preparation of an expert report; the extent to which counsel can assist in the preparation and editing of an expert report; the “common knowledge” rule; the “ultimate issue” rule; and the role of the decision maker in assessing expert evidence.

The book also addresses some associated issues, such as the introduction of evidence from an ‘expert ad hoc’ (i.e. an ‘expert’ who has studied extensive material and gives a summary of the evidence to the jury), and the roles and duties of interpreters and translators.

The foreword was written by Mr Justice Denis McDonald of the High Court, and the book includes a 1999 essay entitled ‘The Role of an Expert Witness’ by the late Adrian Hardiman SC (later Mr Justice Hardiman of the Supreme Court of Ireland).
